General Bicycle Rental Terms and Conditions

The bicycle rental service is provided to guests of the accommodation facility “Casa Cometa” (hereinafter, the “Manager”); the provision of the service is subject to the Customer’s full acceptance of and compliance with the following terms and conditions:

(1) By accepting this document, the Customer declares that they have inspected the bicycle and all rented accessories (e.g. helmets, child seats) and found them to be in perfect working order and good condition.

(2) By accepting this document, the Customer declares that they are of legal age and possess adequate ability and skill, without any reservation. Reception staff may request a valid ID to verify age. The Manager may refuse to rent the bicycle to anyone deemed incapable of riding it (pursuant to Articles 186 and 187 of the Italian Highway Code) or for any other reason, at the Manager’s sole discretion.

(3) The use of the bicycle by minors is permitted only in the presence of an adult who, by signing this rental agreement, assumes full responsibility for the minor’s use of the bicycle, as provided by this agreement and by the Civil Code, and undertakes to ensure that the minor uses the bicycle safely and in compliance with these terms.

(4) The user is required to comply with, and ensure that any minors for whom they have rented the bicycle comply with, the provisions of Legislative Decree No. 285 of April 30, 1992 (the “Highway Code”), as amended, which they declare to be fully aware of. The Manager declines all responsibility in the event of improper use of the bicycle or failure by the Customer to comply with the Highway Code.

(5) Carrying passengers on the bicycle is prohibited unless they are children under 25 kg, seated in the appropriate child seat provided by the Manager.

(6) The bicycle must be used exclusively as a means of tourist/recreational transport on suitable routes and must be handled with care and diligence to avoid damage to the bicycle and its accessories.

(7) It is strictly forbidden to lend or transfer the bicycle to third parties not listed in this rental agreement.

(8) The Customer is responsible for the safekeeping of the bicycle and all accessories and agrees to return them to the same place where they were collected. The bicycle shall be considered returned only when handed directly to the Manager’s staff, who will sign/validate the contract as confirmation of return.

(9) The Customer is fully responsible for any damage caused to themselves, the bicycle, third parties, and/or property during use of the bicycle and, in any case, throughout the entire rental period. In the event of punctures and/or breakdowns requiring roadside assistance by the Manager’s staff, a fixed call-out fee of €15.00 will be charged, in addition to any repair costs.

(10) In the event of loss of keys or accessories, or damage to the bicycle, the Customer agrees to pay the Manager the cost of replacement and/or repair, as specified in Article (12) below.

(11) In the event of loss and/or theft of the bicycle, the Customer must provide the Manager with a copy of the report filed with the competent authorities and will be required to reimburse the value of the bicycle, set at a flat rate of €450.00. If the bicycle is subsequently recovered, the aforementioned amount may be refunded, minus any costs for damage sustained.

(12)Agreed compensation for the most common damages:

  • Loss of lock or keys: €7.00

  • Damage to kickstand: €10.00

  • Damage to light: €10.00

  • Damage to wheel/rim: €20.00

  • Damage to saddle: €10.00

  • Broken brake lever: €10.00

  • Theft or irreparable damage: €450.00

(13) Violation of even one of the above provisions shall entitle the Manager to terminate the contract immediately and repossess the bicycle, without prejudice to any claim for damages.

(14) This contract is governed by Italian law. Any disputes shall fall under the jurisdiction of the court where the Manager is based.

(15) This document is displayed and made available at the Casa Cometa Reception where the service is provided.

(16) PROCESSING OF PERSONAL DATA (Privacy):

The service is reserved for Casa Cometa guests who have already received the privacy notice at check-in, which also covers processing related to ancillary services. More specifically:

The Data Controller for processing related to this activity is Chiara Mantelli.

  • The following data will be processed:

  • Data provided by the Customer in the contract and administrative data related to any payments/compensation (retained for 10 years pursuant to Article 2220 of the Italian Civil Code);

  • Data related to the use of the bicycle necessary to reconstruct events and responsibilities in case of damage, theft, or accidents. Such data will be retained until all possible legal consequences have been resolved.

Legal bases: performance of a contract, protection of company assets, and defense of legal rights in court.
